NextSide — Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the NextSide mobile application, website, and related services (together, the "Service") provided by Cemal Karabulaklı ("we", "us", "our").

By downloading, accessing, or using NextSide, you agree to these Terms. If you do not agree, do not use the Service.

1. What NextSide does

NextSide is an offline-first breastfeeding side-tracker. Its core purpose is to help an adult user answer quickly: which breast was last used, and which side is next?

The App can store feeding logs locally on your device, show recent history, suggest the next side, schedule reminders, show widgets/quick logging surfaces, and offer optional Premium features: the home-screen widget, lock-screen quick log, quick-settings tile, Apple Watch / Wear OS apps, and cloud backup. Logging inside the app is free.

2. Not medical advice

Do not rely on the App for emergencies, health decisions, infant nutrition decisions, medication decisions, or diagnosis. If you have concerns about feeding, milk supply, pain, weight gain, dehydration, illness, or your baby's health, contact a qualified healthcare professional or emergency services.

3. Eligibility and intended users

The Service is intended for parents and adult caregivers. It is not directed to children. You must be legally able to accept these Terms in your country. If you use the Service on behalf of another person or household, you are responsible for having the authority to do so.

4. Local data, accounts, and cloud backup

4.1 Local-first use

The main App can be used without an account. Feeding history is saved to a local database on your device first. You are responsible for your device, backups, and access controls.

4.2 Optional account

Some features, including cloud backup and restore, require an account. You agree to provide accurate account information and to keep your sign-in method secure. You are responsible for activity under your account.

4.3 Premium cloud backup

For signed-in Premium users, feeding history may be copied to Firebase / Google Cloud Firestore so you can back it up and restore it. Backup is not real-time multi-caregiver sync and should not be treated as guaranteed continuous availability. If a restore is offered, it may replace local history on the device.

5. Subscriptions, trials, payment, and cancellation

NextSide may offer paid subscriptions or lifetime access ("Premium"). Purchases are processed by the Apple App Store or Google Play, not directly by us. Store terms, payment rules, taxes, renewal rules, cancellation rules, and refund rules apply to your purchase.

• Subscription pricing and billing periods are shown before purchase.
• Subscriptions may renew automatically unless cancelled through the relevant store before renewal.
• Deleting the App does not automatically cancel a subscription.
• Refund requests are handled by Apple or Google according to their policies, unless applicable law requires otherwise.

6. Acceptable use

You agree not to misuse the Service. For example, you must not:

• attempt to break, reverse engineer, disrupt, or overload the Service;
• use the Service for unlawful, harmful, abusive, or fraudulent activity;
• try to access another user's account or data;
• circumvent payment, subscription, entitlement, or security systems;
• copy, resell, sublicense, or commercially exploit the Service except as allowed by law.

7. Your content and data

You keep ownership of information you enter into the App, such as feeding logs. You give us the limited rights needed to operate requested features, such as storing, backing up, restoring, processing, and displaying that data for you.

Our handling of personal data is described in the Privacy Policy.

8. Intellectual property

The Service, including the app name, design, software, text, graphics, icons, and other materials, is owned by us or our licensors and is protected by intellectual-property laws. These Terms give you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose.

9. Third-party services

The Service may rely on third-party providers including Apple, Google, Firebase, Adapty, and Mixpanel. Their own terms and policies may apply. We are not responsible for third-party services outside our control.

10. Availability and changes

We may update, change, suspend, or discontinue parts of the Service at any time. We aim to keep the core local logging experience fast and reliable, but we do not guarantee that the Service will always be available, error-free, or compatible with every device, operating system, store account, or network.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business, arising from or related to your use of the Service.

Nothing in these Terms limits liability that cannot legally be limited, such as liability for intentional misconduct or rights you have under mandatory consumer-protection laws.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk, misuse the Service, or if we are required to do so by law. Local data on your device remains controlled by your device unless removed by you, the operating system, or uninstalling the App.

14. Governing law

These Terms are governed by the laws of Türkiye, except where mandatory consumer-protection laws in your country require otherwise. If you live in the EU, UK, or another jurisdiction with mandatory consumer rights, you keep those rights.

15. Changes to these Terms

We may update these Terms from time to time. We will change the "Last updated" date above and, for material changes, may provide notice in the App or on the website. Continued use after changes means you accept the updated Terms.
